The Constitution Is Clear

Why “No Troops, No ICE Raids, and Due Process for All” Are Constitutional, Not Radical

The U.S. Constitution and over two centuries of Supreme Court precedent place strict limits on federal power, especially when it threatens civil liberties, state sovereignty, or due process.

Here’s how the Constitution supports every statement on this postcard:

NO Troops in Cities Without State Approval

Constitutional Basis:

• Article VI (Supremacy Clause) binds all government officials—federal and state—to uphold the Constitution and its limits.

• The Posse Comitatus Act (1878) reinforces the Founders’ warning: the U.S. military must not be used for domestic law enforcement without legal authorization.

• As James Madison wrote, “A standing military force, with an overgrown Executive, will not long be safe companions to liberty.”

Legal Precedent:

• Cooper v. Aaron (1958) affirmed that no executive official can act beyond constitutional authority.

• Federal deployment of troops into cities without state consent defies the constitutional balance of federalism.

In short: The Constitution forbids using military force,or militarized federal police,inside states without consent or due process.

NO ICE Raids Without a Judicial Warrant

Constitutional Basis:

• The Fourth Amendment protects against “unreasonable searches and seizures” and requires warrants based on probable cause issued by a judge

• ICE agents, as federal officers, are equally bound by these limits.

Legal Precedent:

• Marbury v. Madison (1803) established that government actions must conform to the Constitution—no agency is above it.

• United States v. Nixon (1974) reaffirmed that not even the President is immune from judicial oversight.

• Yick Wo v. Hopkins (1886) held that enforcement of laws must be even-handed, not arbitrary or discriminatory.

In short: ICE “administrative warrants” signed by ICE agents themselves are not judicial warrants. Raids without a judge’s authorization violate the Fourth Amendment.

Due Process for All, Including Non-Citizens

Constitutional Basis:

• The Fifth Amendment guarantees that no person shall “be deprived of life, liberty, or property, without due process of law.”

• The Fourteenth Amendment extends this protection to all persons within the United States—citizen or not.

Legal Precedent:

• Yick Wo v. Hopkins (1886): The Court declared that constitutional protections apply to all persons within U.S. borders, regardless of citizenship.

• Boumediene v. Bush (2008): Even foreign nationals detained at Guantanamo Bay were found to have the right to habeas corpus under the Constitution.

• Plyler v. Doe (1982): The Court ruled that undocumented immigrants are entitled to equal protection under the Fourteenth Amendment.

In short: Every person within U.S. jurisdiction is entitled to due process. Detaining or deporting people without hearings or warrants violates both the Fifth and Fourteenth Amendments.

Together: A Clear Constitutional Mandate

Each of these provisions, Articles VI, Amendments 4, 5, and 14, works together to restrain federal overreach and protect individual liberty.
The Supreme Court cases cited prove that:

• The Executive Branch is not above the law.

• Federal police powers are limited by constitutional rights.

• All persons deserve due process and equal protection.

Unchecked federal power, whether through troops, ICE raids, or denial of rights, is not just un-American. It’s unconstitutional.
