Why “No Troops, No ICE Raids, and Due Process for All” Are Constitutional, Not Radical

The U.S. Constitution and over two centuries of Supreme Court precedent place strict limits on federal power, especially when it threatens civil liberties, state sovereignty, or due process.

Here’s how the Constitution supports every statement on this postcard:

NO Troops in Cities Without State Approval

Constitutional Basis:

• Article VI (Supremacy Clause) binds all government officials—federal and state—to uphold the Constitution and its limits.

• The Posse Comitatus Act (1878) reinforces the Founders’ warning: the U.S. military must not be used for domestic law enforcement without legal authorization.

• As James Madison wrote, “A standing military force, with an overgrown Executive, will not long be safe companions to liberty.”

Legal Precedent:

• Cooper v. Aaron (1958) affirmed that no executive official can act beyond constitutional authority.

• Federal deployment of troops into cities without state consent defies the constitutional balance of federalism.

In short: The Constitution forbids using military force,or militarized federal police,inside states without consent or due process.

NO ICE Raids Without a Judicial Warrant

Constitutional Basis:

• The Fourth Amendment protects against “unreasonable searches and seizures” and requires warrants based on probable cause issued by a judge

In short: ICE “administrative warrants” signed by ICE agents themselves are not judicial warrants. Raids without a judge’s authorization violate the Fourth Amendment.

• The Fifth Amendment guarantees that no person shall “be deprived of life, liberty, or property, without due process of law.”
